This website is operated by RICHÉMARA LTD, trading as D'A Viticuso ("we", "us", "our"). We are registered in England and Wales under company number 16084388, and our registered office is at Church Farm, Abson Road, Wick, Bristol BS30 5TT, United Kingdom. 2. These terms
These terms apply to every order you place on daviticuso.com. Please read them before ordering, together with our Shipping Policy, Refund and Returns Policy and Privacy Policy, which form part of them.
Our products are sold to consumers for personal use. If you are buying for business purposes, please contact us first.
3. Our products
We photograph and describe our products as accurately as we can. Colours can look different depending on your screen. Our coats are made with natural fibres and fur blends, so small variations in colour, texture and finish between pieces are part of their character and are not faults.
Some pieces are made to order in our standard sizes. The product page tells you whether a piece is in stock or made to order, and our Shipping Policy sets out how long each takes.
Sizing guidance is provided on each product page. If you're unsure, contact us before ordering and we'll help.
Some countries restrict the import of products containing animal fur. If we can't lawfully deliver an item to your destination, we'll tell you and refund you in full.
4. Prices and payment
Prices are shown in your local currency where available. Prices for UK orders are final, with nothing extra to pay. For orders outside the UK, any import duties and taxes are calculated and shown at checkout, as set out in our Shipping Policy.
We take reasonable care to price our products correctly. If we find an obvious pricing error after you've ordered, we'll contact you. You can then buy at the correct price or cancel for a full refund.
We accept the payment methods shown at checkout. Payment is taken when you place your order.
5. How your contract with us is formed
When you place an order, you'll receive an email acknowledging it. This does not mean we have accepted your order. Our contract with you is formed when we email to confirm that your order has been dispatched.
We may decline an order, for example if an item is out of stock, if we can't deliver to your address, or if there's an error in the price or description. If we do, we'll let you know and refund any payment in full.
6. Delivery, risk and ownership
Delivery options, costs and timings are set out in our Shipping Policy. Items are your responsibility from the moment they are delivered to you or to someone you've nominated. Ownership passes to you once we have received payment in full.
7. Cancellations, returns and faulty items
Your right to cancel, how to return an item and what happens if something is faulty are set out in our Refund and Returns Policy. Nothing in these terms affects your legal rights as a consumer.
8. Discount codes and promotions
Unless stated otherwise, only one discount code can be used per order. Codes can't be exchanged for cash and may carry their own terms and expiry dates. We may withdraw a promotion at any time, but withdrawing it won't affect orders already placed.
9. Intellectual property
All content on this website belongs to us or our licensors, including images, text, designs, logos and the D'A Viticuso name and trade marks. You may not copy or reuse it for commercial purposes without our written permission.
10. Our responsibility to you
If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our failure. We are not responsible for loss or damage that was not foreseeable.
We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud, and for breach of your legal rights in relation to the products.
Because our products are for personal use, we are not liable to you for any loss of profit, loss of business or business interruption.
11. Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control. If such an event affects your order, we'll contact you as soon as possible. If the delay is significant, you may cancel and receive a full refund for anything you have paid for but not received.
12. Your personal information
We use your personal information only as set out in our Privacy Policy.
13. Changes to these terms
We may update these terms from time to time. The version that applies to your order is the one shown on this website when you placed it.
14. Other important terms
If a court finds part of these terms unlawful, the rest will continue in force. If we don't insist on something straight away, we can still insist on it later. We may transfer our rights under these terms to another organisation, and we'll tell you if we do; this won't affect your rights. No one other than you and us has any rights under these terms.
15. Law and disputes
These terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts. If you live in the EU, you keep the protection of any mandatory consumer laws in your country of residence.
